Conditions of Hire Equipment

  1. Hire Period: The hire of the Equipment will commence on the date specified on the Hirer’s invoice and continue for the term specified (maximum of 4 days hire).
  2. Equipment Use: The Hirer is entitled to use the Equipment for the hire period. Any amendments to the hire period must be agreed upon by the Owner. The Hirer will not remove the Equipment from the specified location of its installation without the Owner’s consent.
  3. Instructions for Use: The Hirer acknowledges receiving adequate instruction on the correct use of the Equipment, including demonstration, verbal, or written instructions.
  4. Purpose of Use: The Hirer agrees not to use the Equipment for locations or purposes other than those for which it is designated (e.g., indoor vs. outdoor use).
  5. Responsibility and Liability: The Hirer is responsible for the Equipment and liable for any damages, breakages, or loss during the hire period.
  6. Booking Confirmation: The Equipment will only be secured for hire once the bond is fully paid. Failure to pay the bond amount by the agreed date will result in the Equipment being made available for other parties.
  7. Charges: The Hirer agrees to pay the Owner’s hire charges and any other charges, including those for loss, damage, or repairs. All hiring charges, including taxes and duties, must be paid prior to the collection of Equipment.

Payment Terms & Conditions

  1. Hire Charges: The total hire amount includes an optional delivery, setup, pickup fees, and a refundable bond. Any changes may incur additional fees.
  2. Delivery Fees: The delivery, setup, and pickup fees are determined based on the scale of the event and its location.
  3. Bond: The refundable bond amount is specified on the invoice. The bond will be refunded upon the safe and clean return of the Equipment. Any damages, losses, or breakages will reduce the bond refund.
  4. Additional Costs: Late-night delivery services incur additional charges starting from 9 PM. Any changes to agreed pickup times will result in extra charges deducted from the bond.

Damages, Breakages, Loss & Cleaning of Equipment

  1. Responsibility for Equipment: The Hirer is fully responsible for the condition of the Equipment during the hire period.
  2. Notification of Issues: The Hirer must notify the Owner of any damages, breakages, or losses at the time of return.
  3. Repairs: Repairs of damaged Equipment must not be undertaken without the Owner’s written consent.
  4. Bond Deductions: The bond will be reduced based on the cost of damages, breakages, or losses. If the damage exceeds the bond, the Hirer agrees to reimburse the remaining cost.
  5. Replacement Costs: Replacement costs will reflect the current retail value of the damaged or lost items. The Hirer acknowledges that some items may be expensive to replace, leading to full or partial bond loss.
  6. Cleaning: All tableware must be washed, cleaned, and returned in the same condition as provided. Failure to do so will result in a cleaning fee starting at $50 depending how many items are returned dirty. A full loss of bond may be the result of tableware not being returned in the same condition as it was provided.

Repacking and Handling of Equipment

  1. Repacking: All Equipment must be returned in its original crates, boxes, or packaging.
  2. Fragile Items: Fragile items, such as glassware and cake stands, must be hand-washed and handled with care. Glassware must not be washed in dishwashers.
  3. Cleaning Products: Specific cleaning products provided by the Owner for items such as donut walls must be used and returned with the Equipment.

Booking Amendments

  1. Additional Equipment: Additional items can be added to the booking by submitting a wish list. A revised invoice will be issued, and payment must be made by the agreed date.
  2. Failure to Pay: Failure to pay for additional bookings will result in all Equipment being made available for other parties. Any prior payments made will be forfeited.
  3. No-Show: If the Hirer is not present at the agreed pickup location, the bond will be forfeited to cover losses and expenses.

Late Fees for Hire Items

  1. Late Returns: A late fee of $50 per day will be charged for Equipment not returned on time unless prior arrangements are made with the Owner.

Cancellation of Hire

  1. Written Notification: Cancellations must be provided in writing.
  2. Refund Policy:
  • 30+ Days Prior: Full refund of the hire amount; full loss of bond.
  • Within 30 Days: No refund of hire value or bond.
  • Rescheduled Events: If an event is rescheduled once and then cancelled, no refund will be issued.
  1. COVID Policy: Lifetime credit will be provided for future events; no refunds.
  2. Owner Termination: The Owner reserves the right to terminate the hire at any time without liability.

Indemnity

The Hirer assumes all risks and agrees to indemnify and hold the Owner harmless from any property damage or personal injury resulting from the use of the Equipment. The Hirer releases the Owner from third-party claims or demands arising out of the use of the Equipment.

Agreement

By making any form of payment of the hire amount or bond, the Hirer agrees to the terms and conditions outlined above.
